Introduction

Welcome to The LoadedCrysis Cluster! These Terms and Conditions (“Terms”) govern your access to and use of our online store and related digital services.

The LoadedCrysis Cluster is a community project operated by LoadedCrysis Ltd, which manages and maintains all store operations, transactions, and services.

By purchasing any items or memberships from our store, you agree to be bound by these Terms in full.

Nature of the Services

The LoadedCrysis Cluster offers digital, in-game items such as dinosaurs, gear, and other virtual assets for ARK: Survival Ascended.

All items are virtual goods that exist only within the game environment and have no real-world monetary value.

Ownership of these items remains with The LoadedCrysis Cluster. You receive a limited, revocable license to use them in-game.

Monthly Memberships

We offer optional monthly memberships that allow players to support The LoadedCrysis Cluster and receive exclusive in-game perks in return.

By subscribing, you acknowledge and agree that:

• Memberships renew automatically on a monthly recurring basis until canceled.

• Membership benefits, rewards, and prices may change at any time at our discretion.

• Membership fees are non-refundable. No refunds or partial credits will be provided under any circumstances.

You may cancel your membership at any time by:

• Opening a support ticket in our Official Discord: discord.gg/loadedcrysis, or

• Cancelling via your Tebex confirmation email.

All purchases made on The LoadedCrysis Cluster Store are final and non-refundable.
By completing a purchase, you agree that:

• You will not initiate chargebacks or disputes through your payment provider.

• Digital items cannot be returned, exchanged, or refunded.

• Refunds will not be issued for dissatisfaction, gameplay issues, or accidental purchases.

Delivery of Digital Items

Upon successful payment, purchased items will be delivered to your in-game character.
Delivery times vary based on server performance and item type.
Items are typically delivered within 5 minutes, but please allow up to 60 minutes.

BETA Delivery Notice

Our automatic delivery system is currently in BETA. To minimize issues:

• Limit purchases to one package per transaction.

• Ensure you are online and on the correct server during purchase.

• If items are missing after 60 minutes, please create a ticket on our Discord.

Note: As ARK: Survival Ascended is currently unsupported by Tebex, we recommend making purchases on lower-populated servers to avoid delivery issues.

Account Responsibilities

You are solely responsible for ensuring your in-game character and account are eligible to receive purchased items.

The LoadedCrysis Cluster is not responsible for:

• Loss of items due to bans, suspensions, or game crashes.

• Delivery delays caused by incorrect player details.

• Lost items due to in-game events, technical issues, or wipes beyond our control.

Use of Funds / Cluster Support

All payments made through The LoadedCrysis Cluster Store are voluntary contributions to support the operation, maintenance, and development of our community servers.

Funds may be used at our discretion for:

• Hosting, software, or server costs (including partnered or sponsored servers).

• Hardware upgrades, network infrastructure, or community tools.

• Administrative, moderation, or technical support.

• Marketing, development, and other operational costs related to the cluster.

Some parts of our infrastructure may be provided under sponsorships or partnerships (e.g., with Nitrado).
Purchases still contribute to the overall growth, stability, and future expansion of The LoadedCrysis Cluster as a whole.

We do not guarantee that 100% of funds will be allocated to specific servers or hosting costs.

Server Rules and Conduct

By purchasing and using items on our servers, you agree to follow The LoadedCrysis Cluster’s rules and community guidelines.

Violation of these rules may result in:

• Item forfeiture,

• Account restrictions, or

• Permanent bans without compensation.

Disclaimer

The LoadedCrysis Cluster is an independent community-run project and is not affiliated with, sponsored by, or endorsed by Studio Wildcard or Snail Games.

All purchases are voluntary and support the continued development of our community servers.
We make reasonable efforts to ensure uptime and reliability but do not guarantee uninterrupted access or performance.

Limitation of Liability

To the fullest extent permitted by law:

• The LoadedCrysis Cluster shall not be liable for any direct, indirect, or consequential losses, including but not limited to loss of virtual items, downtime, or data loss.

• We cannot guarantee specific stats, qualities, or features of purchased in-game packages.

• All items are delivered “as is” and may be affected by future game patches or server resets.

Refunds and Faulty Goods

If a purchased digital item is undelivered or faulty due to an error on our part, please contact us via Discord or email for review.
We may issue replacements or refunds at our discretion.
Refunds are not provided for dissatisfaction, performance issues, or changes of mind.
Your statutory consumer rights (if applicable) remain unaffected.

Jurisdiction and Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless otherwise required by law.

Changes to Terms

We reserve the right to amend these Terms at any time. Updates take effect immediately upon posting on our website. Continued use of our store constitutes acceptance of the revised Terms.
